Terms of Service

1. Who we are

Spotter.fit is operated by Gustavo Serres, an individual sole operator based in Portugal ("we", "us"). You can reach us at hello@spotter.fit.

By creating an account or using Spotter.fit you agree to these terms. If you do not agree with them, do not use the service.

2. The service

Spotter.fit is a coaching platform for personal trainers and their clients. Trainers use it to build exercise libraries, workouts and multi-week plans, schedule them on client calendars, and review what clients actually did. Clients use it to follow their plan, log training, complete check-ins and surveys, and communicate with their trainer.

Spotter.fit is currently in invite-only early access. Features may change, appear and disappear while the service matures.

3. Accounts and eligibility

  • You must be at least 16 years old to create an account.
  • You must provide accurate information and keep it up to date.
  • You are responsible for what happens under your account and for keeping your sign-in credentials and devices secure. Tell us promptly at hello@spotter.fit if you believe your account has been compromised.

4. Workspaces and roles

Spotter.fit is organised in workspaces. The trainer (or organisation) that creates a workspace administers it: they invite clients and staff, assign roles, and decide what is scheduled for whom. If you are a client, your relationship as a training client — advice, programming, results — is with your trainer, not with Spotter.fit. Trainers are independent professionals; they are not our employees or agents, and we do not supervise, endorse or verify their qualifications or their advice.

5. Subscriptions and billing

Paid subscriptions are sold through Creem.io, which acts as Merchant of Record. This means your purchase contract is with Creem: Creem runs the checkout, charges your payment method, stores your card details and handles VAT and invoicing. Billing questions can be raised with us or directly through Creem's customer portal.

  • Prices, plans and any trial periods are shown at the time of purchase.
  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
  • If a renewal payment fails, access to paid features may be restricted until payment is resolved.
  • If you are a consumer in the EU, you have a 14-day right of withdrawal for online purchases. By starting to use a paid subscription immediately, you request immediate performance; if you withdraw within the 14 days, you may be charged proportionally for the period already used, as EU consumer law provides.

6. Your content

Everything you put into Spotter.fit — exercises, plans, notes, photos, videos, survey answers — remains yours. We claim no ownership of it.

So that the service can function, you grant us a limited, non-exclusive licence to host, store, process, transcode and display your content, only as needed to provide the service to you and the people you share it with. This licence ends when the content is deleted from the platform.

You are responsible for the content you upload: you must have the rights to it, and it must not be unlawful. If you upload media of other people (for example a client's check-in photos on their behalf), you are responsible for having their permission.

7. Acceptable use

You agree not to:

  • use the service for anything unlawful;
  • access other people's data beyond what your role in a workspace grants you;
  • probe, disrupt or overload the service, or attempt to bypass its security or usage limits;
  • scrape the service or resell access to it without our written agreement;
  • upload content that infringes someone else's rights, or malware of any kind.

We may suspend or terminate accounts that violate these rules.

8. Intellectual property

The Spotter.fit software, design, brand and exercise catalogue remain our property (or that of our licensors). These terms give you a personal, non-transferable right to use the service; they transfer no other rights.

9. Not medical advice

Spotter.fit is a software tool. Nothing on the platform — including exercise descriptions, training plans, or anything written by a trainer — is medical advice, and we are not a healthcare provider. Physical exercise carries inherent risk. Consult a physician before starting or changing an exercise programme, especially if you have a medical condition, and stop and seek medical attention if you feel pain or discomfort. Decisions about your training and health are yours and your trainer's, not ours.

10. Availability and changes to the service

We work to keep Spotter.fit available and your data safe, but the service is provided "as is" and "as available" to the extent permitted by law. We do not guarantee uninterrupted availability, and we may change, add or remove features. If we ever discontinue the service, we will give you reasonable notice and the opportunity to export your data.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential damages — such as lost profits, lost data caused by circumstances outside our control, or the outcomes of training decisions — and our total liability arising out of the service is limited to the amounts you paid for it in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot be excluded under Portuguese or EU law, including liability for intent (dolo) or gross negligence, for death or personal injury caused by our fault, or your statutory rights as a consumer.

12. Termination

You can stop using Spotter.fit and delete your account at any time in the app; deletion of your data is described in the Privacy Policy. We may suspend or terminate your account if you materially breach these terms, and where reasonable we will warn you first. Sections that by their nature survive termination (such as sections 6, 8 and 11) continue to apply.

13. Changes to these terms

We may update these terms as the service evolves. For material changes we will notify you — in the app or by email — before they take effect. If you keep using the service after the changes take effect, the new terms apply; if you do not agree with them, you may delete your account.

14. Governing law and disputes

These terms are governed by Portuguese law. If you are a consumer residing in the European Union, you additionally enjoy the mandatory consumer protections of your country of residence, and you may bring proceedings in that country.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We prefer to resolve issues directly — write to us first.
