Terms of Service
Last updated: 29 October 2026
1. Who we are
Spotter.fit is operated by Gustavo Serres, an individual sole operator based in Portugal ("we", "us"). Our postal address is Rua da Horta de Fanares, 26, 2A, 2725-326 Mem Martins, Portugal, and our tax number (NIF) is 312377827. You can reach us at hello@spotter.fit.
By creating an account or using Spotter.fit you agree to these terms. If you do not agree with them, do not use the service.
2. The service
Spotter.fit is a coaching platform for personal trainers and their clients. Trainers use it to build exercise libraries, workouts and multi-week plans, schedule them on client calendars, and review what clients actually did. Clients use it to follow their plan, log training, complete check-ins and surveys, and communicate with their trainer.
A workspace can also track daily habits and post announcements to its members. Depending on the plan, it can exchange direct messages, upload its own exercise videos, review clients' form videos, and connect an external AI assistant that then acts on the workspace's data with the permissions of the person who connected it — see the Privacy Policy.
Spotter.fit is a young service that is opening gradually: for now, creating a new workspace may require an invitation. Features may change, appear and disappear while the service matures.
If you install the mobile app from Apple's App Store or from Google Play, the store's own terms apply to the download as well. Apple and Google are not parties to these terms and are not responsible for the app, its content or its support.
3. Accounts and eligibility
- You must be at least 16 years old to create an account.
- You must provide accurate information and keep it up to date.
- You are responsible for what happens under your account and for keeping your sign-in credentials and devices secure. Tell us promptly at hello@spotter.fit if you believe your account has been compromised.
4. Workspaces and roles
Spotter.fit is organised in workspaces. The trainer (or organisation) that creates a workspace administers it: they invite clients and staff, assign roles, and decide what is scheduled for whom. If you are a client, your relationship as a training client — advice, programming, results — is with your trainer, not with Spotter.fit. Trainers are independent professionals; they are not our employees or agents, and we do not supervise, endorse or verify their qualifications or their advice.
5. Subscriptions and billing
We sell paid subscriptions ourselves: your purchase contract is with us, and we issue your invoices. Payments are handled by Stripe, our payment service provider — Stripe takes the payment and stores your card details, so your card number never reaches us. Stripe processes payments for us; it is not the seller. Subscribing, switching plan or billing interval, updating your payment method, cancelling and resuming all happen inside the app, and your charges are listed there; a charge's receipt, and the page for paying a charge that is still due, are hosted by Stripe. There is no separate billing portal. Billing questions come to us at hello@spotter.fit.
- Prices, plans and any trial periods are shown at the time of purchase. A discount applies for the period stated when you take it; after that, the regular price applies. Subscriptions are bought and managed on the web; the mobile app shows your plan read-only.
- You can pay by card, Link, Apple Pay or Google Pay. Prices are in euros, except the Brazilian prices below; if your card is in another currency, your card issuer converts the charge and may apply its own exchange rate and fees.
- Prices are final, and no VAT is charged. We are exempt from VAT under article 53 of the Portuguese VAT Code (Código do IVA), so the amount we show you before you pay is the amount we charge, and your invoice states the exemption.
- Brazil. If you have a Brazilian billing address and a CPF or CNPJ, and pay with a card issued in Brazil, you pay fixed prices in Brazilian reais (BRL): Starter R$99.90 a month or R$999 a year, Pro R$199.90 a month or R$1,999 a year. The Brazilian price is only for a card issued in Brazil: if a subscription at that price is paid with a card issued elsewhere, we do not accept the payment, we cancel the subscription and we refund what was charged in full.
- Invoices. For every charge we issue a certified Portuguese invoice (fatura), in euros, and send it to you; it is the invoice for tax purposes. For a charge in Brazilian reais, the invoice also shows the amount in reais and the exchange rate used. The receipt Stripe provides is proof of payment only, not an invoice.
- Your first workspace can start a 14-day free trial of the Pro plan, including its member limit. No payment method is needed and nothing is charged; when the trial ends, the workspace is locked until you subscribe, and you may extend the trial once, by 7 days, from that screen. A trial is available once per account.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- If you change plan or billing interval during a billing period, the change takes effect immediately and you are charged or credited the prorated difference.
- If you move to a plan that does not include features you have been using — for example from Pro to Starter, or from a trial to Starter — the change likewise takes effect immediately. Where the workspace exceeds the new plan's member limit, you first choose which members to suspend. The content of the features you give up — uploaded exercise videos, client form videos, the frame captures of video reviews and all direct messages — is permanently deleted 15 days after the downgrade; the deletion cannot be undone, and only upgrading back to a plan that includes those features before the 15 days have passed cancels it. See also the Privacy Policy.
- You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. You can resume a cancelled subscription at any time before it ends. Once the subscription has ended, the workspace is locked for all of its members, clients included, until a new subscription is taken out. Its data is kept, and is deleted only if you delete the workspace or your account, as described in the Privacy Policy.
- If a renewal payment fails, the workspace keeps its access for 7 days after the end of the paid period while the payment is retried. If the payment is still outstanding after those 7 days, the workspace is locked until it goes through.
- Payments are not refunded, except where the law gives you that right — the right of withdrawal below is one such case. When you move to a cheaper plan, the unused part of what you paid is credited towards your next invoices, not paid back. A payment at the Brazilian price that we do not accept, as described above, is refunded in full.
- If you are a consumer in the EU, you have a 14-day right of withdrawal for online purchases, counted from the day of the purchase. To use it, tell us before the 14 days have passed that you withdraw — an email to hello@spotter.fit is enough, and you need not give a reason; you may use the model withdrawal form below, but you do not have to. At checkout you ask us, by ticking the box there, to start your plan at once, without waiting for the 14 days to pass. Because of that request, if you withdraw within the 14 days you pay for the days already used, from the day your plan started to the day you tell us, in proportion to the period you paid for. We refund the rest within 14 days of the day you tell us, by the same means of payment you used. If you are a consumer in Brazil, you may withdraw in the same way within 7 days of subscribing, and we refund you in full.

6. Your content
Everything you put into Spotter.fit — exercises, plans, notes, photos, videos, survey answers — remains yours. We claim no ownership of it.
So that the service can function, you grant us a limited, non-exclusive licence to host, store, process, transcode and display your content, only as needed to provide the service to you and the people you share it with. This licence ends when the content is deleted from the platform.
You are responsible for the content you upload: you must have the rights to it, and it must not be unlawful. If you upload media of other people (for example a client's check-in photos on their behalf), you are responsible for having their permission.
7. Acceptable use
You agree not to:
- use the service for anything unlawful;
- access other people's data beyond what your role in a workspace grants you;
- probe, disrupt or overload the service, or attempt to bypass its security or usage limits;
- scrape the service or resell access to it without our written agreement;
- upload content that infringes someone else's rights, or malware of any kind.
We may suspend or terminate accounts that violate these rules.
To report content on Spotter.fit that you believe is unlawful, write to hello@spotter.fit, telling us where the content is and why you consider it unlawful; we review every report and tell you what we decided. The same address is our point of contact for users and for authorities under the EU Digital Services Act. You can write to us in Portuguese or in English.
8. Intellectual property
The Spotter.fit software, design, brand and exercise catalogue remain our property (or that of our licensors). These terms give you a personal, non-transferable right to use the service; they transfer no other rights.
9. Not medical advice
Spotter.fit is a software tool. Nothing on the platform — including exercise descriptions, training plans, or anything written by a trainer — is medical advice, and we are not a healthcare provider. Physical exercise carries inherent risk. Consult a physician before starting or changing an exercise programme, especially if you have a medical condition, and stop and seek medical attention if you feel pain or discomfort. Decisions about your training and health are yours and your trainer's, not ours.
10. Availability and changes to the service
We work to keep Spotter.fit available and your data safe, but the service is provided "as is" and "as available" to the extent permitted by law. We do not guarantee uninterrupted availability, and we may change, add or remove features. If we ever discontinue the service, we will give you reasonable notice and the opportunity to export your data.
11. Liability
To the extent permitted by law, we are not liable for indirect or consequential damages — such as lost profits, lost data caused by circumstances outside our control, or the outcomes of training decisions — and our total liability arising out of the service is limited to the amounts you paid for it in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot be excluded under Portuguese or EU law, including liability for intent (dolo) or gross negligence, for death or personal injury caused by our fault, or your statutory rights as a consumer.
12. Termination
You can stop using Spotter.fit and delete your account at any time in the app; deletion of your data is described in the Privacy Policy. We may suspend or terminate your account if you materially breach these terms, and where reasonable we will warn you first. Sections that by their nature survive termination (such as sections 6, 8 and 11) continue to apply.
13. Changes to these terms
We may update these terms as the service evolves. For material changes we will notify you — in the app or by email — before they take effect. If you keep using the service after the changes take effect, the new terms apply; if you do not agree with them, you may delete your account.
14. Governing law and disputes
These terms are governed by Portuguese law. If you are a consumer residing in the European Union or in Brazil, you additionally enjoy the mandatory consumer protections of your country of residence, and you may bring proceedings in that country.
We prefer to resolve issues directly — write to us first, at hello@spotter.fit. If you are a consumer and a dispute remains, you may take it to an alternative dispute resolution entity for consumer disputes. In Portugal these entities are listed by the Directorate-General for Consumers at www.consumidor.gov.pt; one of them, with nationwide competence, is the CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt).
